Duration of the working time
- The ordinary working time per a Normal Employment contract is 8 hours per day and 40 hours per week.
- Increased working time is allowed because of production reason and on a later stage shall be compensated with reduction of the working time. The Employer shall inform the Labour Inspection for this. The duration of the increased working time can not be more than 10 hours per day and 48 hours per week. For the employees with reduced working time this increase can not be more than 1 hour above the agreed reduced working time per day and more than 40 hours per week. The increasing can not be longer than 60 days in 1 calendar year and for more than 20 consecutive working days. The employer is obliged to compensate the increasing of each working day within a 4 months period.
- Reduced working time is applicable for employees with specific working conditions and employees under 18 years of age.
- The maximum duration of the working time for one
employee in total for his Normal Employment contract
plus Additional Employment contracts under art.110 and
art.111 from the Labour code are as follows:
- 40 hours per week – for employees and workers not reach the age of 18;
- 48 hours per week – for the employees and workers above 18 years of age;
Upon explicit consent
in writing expressed by the Employees, they are entitled
to work more than 48 hours per week. The consent in writing
shall be given at the signing of the Additional Employment
Contract either to the one Employer /if the case is under
art.110/ or to the both Employers /if the case is under
art.111/. Provided that the employee or the worker rejects
to work more than 48 hours per week, he can not be obliged
to do so, and his refusal can not lead to his dismissal
or any other bad consequences. If the employee or the worker had given his consent for working above 48 hours per week then the duration of the working time should have been calculated for period no longer than 4 months. For all cases of additional work /more than 8 hours per day and 40 hours per week/, the total duration of working time shall not breach the uninterrupted minimum daily /12 hours/ and weekly rest /1 day/ ascertained with the Labour code.
The employer is obliged to keep documentation for each employee or worker who works more than 48 hours per week in compliance with art.110 from the Labour Code and the documentation shall be presented to the Head Labour Inspection under request.
The additional work is forbidden for some positions and age of the employees.
